These general terms and conditions of sale apply to orders placed on the website www.lagoped.com (hereinafter referred to as the "Site") which is operated by:

OBJECT

These general terms and conditions of sale define the contractual relations between Lagoped and the buyer and the conditions applicable to any purchase of articles made on the Site, whether the buyer is a professional or a non-professional consumer. The acquisition of an article on the Site implies unreserved acceptance by the buyer of these general terms and conditions of sale. These general terms and conditions of sale shall prevail over any other general or specific conditions not expressly approved by Lagoped. Lagoped reserves the right to modify its general terms and conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer.

CHARACTERISTICS OF THE ITEMS OFFERED FOR SALE

The items offered are those listed in the catalog published on the Site, subject to availability. Each item is accompanied by a comprehensive description that specifies the composition and origin of the materials used as well as the place of production. The photographs in the catalog are as faithful as possible but cannot ensure a perfect similarity with the items offered for sale, particularly in terms of colors. We take the greatest care, but a photograph, however faithful it may be, is only a representation of reality that passes through a lens, then a screen (computer / mobile phone).

PRICES

The prices of the items are displayed on the Site including VAT in Euros and take into account the VAT applicable on the day of the order. Any change in the VAT rate will be reflected in the price of the items but cannot in any case change the price indicated on the day of the order. Lagoped reserves the right to change its prices at any time and without notice, however, it is understood that the price listed on the Site on the day of the order will be the only one applicable to the buyer, except in the case of a manifest error. All prices listed on the Site do not include shipping costs as long as the place of delivery is in a geographical area specified below. Shipping fees are applied to each order. If a pricing error occurs on our site, we are not obliged to sell the item(s) concerned at the erroneous, lower price.

GEOGRAPHICAL AREA

The online sale of the items presented on the Site is reserved for buyers who reside in the European Union, Switzerland, Canada, Japan, and the United States and for deliveries required in these geographical areas.

PLACING AN ORDER

To purchase an item on the Site, you will follow these steps:

1- Locate the item on the Site and read the description to ensure it suits the intended use, learn its origin, and discover the techniques and know-how employed in its manufacture.

2- Select the color, size (do not forget to consult the size guide), and quantity.

3- Transfer the selected items to your basket by clicking on the "Add to cart" button.

4- Review your basket before moving to the stage of validating the order by clicking on the "Order" button, which triggers 5 steps or you can continue shopping on the Site.

5- Validate your order after having checked it at the "Summary" stage where all elements of the chosen items are listed and which indicates the total price, then click on the "Order" button.

6- At the "Login" step, you log into your account if you already have one, or you create an account by filling in an identification form with all the necessary details, then click on "Order".

7- Choose your "Address" for delivery and specify a billing address which can be different, for example, to make a gift to someone you love. At this stage, you can add addresses if necessary. Then you click on "Order".

8- Choose your standard or express delivery mode. To be able to click on "Order" and move to the last payment step, you must formally accept the general terms and conditions of sale which you can display by clicking on the underlined hyperlink.

9- At the "Payment" stage, choose your preferred secure payment method and you will be redirected to the service provider we have selected who manages the payment of your order.

The confirmation of the order implies acceptance of these general terms and conditions of sale, acknowledgment of having full knowledge of them, and waiver to avail oneself of one's own purchasing conditions or other conditions. All provided data and the recorded confirmation will serve as proof of the transaction.

We will send you an email confirmation of the shipment of the registered order. The shipment confirmation will serve as a signature and acceptance of the operations performed.

RETURNS (PURCHASES ON THE WEBSITE)

You can return your items purchased on the Site whenever you wish and even beyond the legal withdrawal period by following the procedure described below provided that the item(s) returned are in their original condition, unworn and with all of their labels.

To return an item
1/ Log in using the button at the top right with the email you used to place the order.
2/ Select the order number for which you wish to request a return. In the upper right corner, click "Request a Return".
3/ Choose the product(s) you wish to return.
4/ Select the reason why you wish to return the product.
5/ If this is an exchange, please leave a comment in the box indicating which product you would like in exchange (don't forget to specify the size and color).
Finally, click on the “Request a Return” button.

Shipping label
An email will be sent to you with the return label after we have accepted your return request.

Upon receipt of the returned product, you will receive a refund or the exchange product will be sent to you.

MEDIATION

Lagoped has chosen the Consumer Mediation Centre of the Conciliators of Justice (CM2C).

The implementation of mediation is initiated from the website or by contact via email at cm2c@cm2c.net. Recourse to the mediator can also be done by regular mail (include your email, your phone number and the written complaint) to CM2C 14 rue Saint Jean 75017 Paris.

LEGAL WARRANTIES

The products sold by Lagoped benefit from the legal warranty of conformity provided by articles L. 217-4 to L. 217-12 of the Consumer Code and the legal warranty against hidden defects of the sold item under the conditions provided in articles 1641 to 1648 and 2232 of the Civil Code, provided that the use has been normal and the maintenance advice has been followed by the customer.

LEGAL WARRANTY OF CONFORMITY

In accordance with articles L. 217-1 et seq. of the Consumer Code, Lagoped ensures the warranty of conformity of the products sold.

When implementing the legal warranty of conformity, the customer:

  • has a period of two (2) years from the delivery of the good to act;

  • can choose between repair or replacement of the good, provided that this choice does not incur a cost clearly disproportionate to Lagoped compared to the other modality, given the value of the good or the extent of the defect. The customer is exempt from providing proof of the existence of the product’s conformity defect during the first twenty-four (24) months following the delivery of a new product and the six (6) months following the delivery of a used product. Beyond this period of six (6) months for used products, the customer must provide proof that the good is not suitable for the usually expected use of a similar good or that it does not have the characteristics defined by mutual agreement by the parties.

This legal warranty of conformity applies regardless of any commercial warranty that may be granted.

The products sold benefit from legal guarantees provided that the use has been normal and the maintenance advice has been followed.

This guarantee does not cover damages resulting from improper use of the product or normal wear and tear due to its use. To benefit from the product warranty, it is imperative to keep the purchase invoice of the product.

For all product returns and customer service, the return procedure must be requested by the Customer by sending an email to: client@lagoped.com.

WARRANTY AGAINST HIDDEN DEFECTS

The client may also decide to implement the legal warranty against hidden defects of the Product sold under the terms of article 1642 of the Civil Code, resulting from a design or manufacturing defect that makes the product unfit for its intended use, excluding any negligence or fault on the part of the client. The client can then choose between the resolution of the sale or a reduction of the selling price in accordance with article 1644 of the Civil Code.

LAGOPED WARRANTY

We guarantee all our articles for 5 years in the context of use conforming to their intended purpose.

The implementation of the warranty means that you do not pay for the repair costs but the transportation costs are at your charge. We are proud of what we have designed, developed, and manufactured. This warranty does not cover wear related to improper use of the item. For example: tearing due to a fall, a cut by a sharp object (stick), cutting (ski edge) or slicing (ice axe). If the defect is not eligible for the application of the warranty, we will propose an economical repair for your damaged item.

To implement the warranty, you send us an email (client@lagoped.com) and provide us with:

a photograph of the product and its defect the receipt or proof of purchase (ideally, otherwise the reference on the item allowing us to identify it) your client number if you have an account otherwise your address and phone number

After verifying that the quality defect can be covered under the Lagoped warranty, we will provide you with the return slip and the repair times.

REPAIRS

 

Lagoped offers to repair damaged items that are not covered under the Guarantee. Repair costs and transport costs will be your responsibility.

To return an item for repair, you must:
1. Go to the Lagoped web page
2. Click on the “request a repair” link

3. Complete the after-sales service form with the requested information.
4. And we will get back to you soon with the repair procedure.

Important: If the repair is not covered under the warranty, we will offer you an economical repair for your damaged item and we will provide you with the return slip as well as the indicative repair times.

Items requiring repair will need to be washed before shipping.

Repair time
It takes 3 weeks from the item being sent for repair, but sometimes times can extend in the event of an overload of repairs. We are doing our best and thank you for your patience.

PAYMENT

The price is payable upon order. Payment can be made using the payment methods indicated during the order process on the Website. Our providers comply with required security standards. Your payment information is encrypted and will only be transmitted over the internet in a protected form so that no third party can access it during transmission over the network.

The buyer’s account will only be charged at the time of the shipment of the products or services available and only for the amount of the products or services sent or downloaded. Exceptionally, in the case of a pre-order, the buyer’s account will be charged the total amount of the products before the shipment of the products. To obtain an invoice showing VAT, you simply need to visit your client account using your login credentials.

DELIVERIES

We strive to process and ship orders within 1 to 2 business days (Monday to Friday, excluding public holidays) once payment is validated. We offer two modes of delivery: standard delivery (Colissimo) and express delivery (Chronopost). Deliveries are made to the address indicated in the order form which can only be within the agreed geographical area.

LIABILITY

In the process of online selling, Lagoped is only bound by a duty of means. Its liability cannot be held for damages resulting from the use of the Internet such as data loss, intrusion, viruses, service disruption, or other involuntary problems.

INTELLECTUAL PROPERTY

All elements of the Lagoped website are and remain the intellectual and exclusive property of Lagoped. It is strictly forbidden to reproduce, exploit, redistribute, or use in any way, even partially, elements of the site whether they are software, visuals, or sounds without our prior written consent.

ARCHIVING – PROOF

Lagoped will archive purchase orders and invoices on a reliable and durable medium that constitutes a faithful copy in accordance with the provisions of Article 1348 of the Civil Code. The computerized records of Lagoped will be considered by the parties as proof of communications, orders, payments, and transactions occurred between the parties.

DISPUTE RESOLUTION

These general sales conditions are subject to French law. In the event of a dispute, jurisdiction is granted to the competent courts according to applicable procedural rules.
