OBJECT

These general terms and conditions of sale define the contractual relationship between Lagoped and the buyer and the conditions applicable to any purchase of items made on the Site, whether the buyer is a professional or a non-professional consumer. The acquisition of an item on the Site implies unreserved acceptance by the buyer of these general terms and conditions of sale. These general terms and conditions of sale shall prevail over any other general or specific conditions not expressly approved by Lagoped. Lagoped reserves the right to modify its general terms and conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

CHARACTERISTICS OF ITEMS OFFERED FOR SALE

The items offered are those listed in the catalog published on the Site within the limits of available stocks. Each item is accompanied by a comprehensive description specifying the composition and origin of the materials used as well as the place of production. The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the items offered for sale, particularly with regard to colors. We take the greatest care, but a photograph, however faithful, is only a representation of reality that passes through a lens, then through a screen (computer / mobile phone).

PRICING

The prices of the items are displayed on the Site in Euros, including all taxes (TTC), and take into account the VAT applicable on the day of the order. Any change in the VAT rate will be reflected in the price of the items but strictly cannot change the price indicated on the day of the order. Lagoped reserves the right to modify its prices at any time and without notice, it being understood, however, that the price appearing on the Site on the day of the order will be the only one applicable to the buyer, except in the case of a manifest error. All prices indicated on the Site do not include shipping costs provided that the place of delivery is in a geographical zone provided for below. Shipping costs are applied to each order. If a price error creeps into our site, we will in no way be obliged to sell the item(s) concerned at the erroneous price, if lower than the real price.

GEOGRAPHIC AREA

The online sale of items presented on the Site is reserved for buyers residing in the European Union, Switzerland, Canada, Japan, and the United States and for deliveries required in these geographical zones.

PLACING AN ORDER

To purchase an item on the Site, you will follow these steps:

1- Locate the item on the Site and read the description to check that it corresponds to the intended use, know its origin, and discover the techniques and know-how used to manufacture it

2- Select the color, the size (don't forget to consult the size guide) and the quantity

3- Transfer the selected items to your cart by clicking on the "Add to cart" button

4- Consult your cart before proceeding to the order validation stage by clicking on the "Checkout" button which triggers 5 steps, or you can continue shopping on the Site

5- Validate your order after checking it at the "Summary" stage where all the elements of the chosen items are listed and which indicates the total price, then click on the "Checkout" button

6- At the "Login" stage, you log in to your account if you already have one or create an account by filling out an identification form containing all the necessary contact details, then click on "Checkout"

7- Choose your delivery "Address" and specify a billing address which can be different, for example, to give a gift to someone you love. At this stage, you can add addresses if necessary. Then click on "Checkout"

8- Choose your standard or express delivery method. To be able to click on "Checkout" and proceed to the final payment step, you must formally accept the general terms and conditions of sale which you can display by clicking on the underlined hyperlink

9- At the "Payment" stage, you choose the secure payment method that suits you best and you will be redirected to the provider we have selected who manages the payment of your order.

Confirmation of the order entails acceptance of these general terms and conditions of sale, acknowledgement of having perfect knowledge of them, and waiver of the right to avail oneself of one's own conditions of purchase or other conditions. All data provided and the recorded confirmation will serve as proof of the transaction.

We will send you an email confirming the shipment of the recorded order. The shipment confirmation will serve as signature and acceptance of the operations carried out.

RETURNS (PURCHASES ON THE SITE)

You can return items purchased on the Site whenever you wish and even beyond the legal withdrawal period by following the procedure described below, provided that the returned item(s) are in their original condition, unworn, and with all their tags.

To return an item:
1/ Log in using the button at the top right with the email you used to place the order.
2/ Select the order number for which you want to request a return. In the top right corner, click on "Request return".
3/ Choose the product(s) you wish to return.
4/ Select the reason why you want to return the product.
5/ If it is an exchange, please leave a comment in the box indicating which product you want in exchange (don't forget to specify the size and color).
Finally, click on the "Request return" button.

Shipping label:
An email with the return label will be sent to you after we have accepted your return request.

Upon receipt of the returned product, you will receive either a refund or the exchange product will be sent to you.

MEDIATION

Lagoped has chosen the Centre de médiation de la consommation de conciliateurs de justice (CM2C).

Mediation is initiated from the website or by email at cm2c@cm2c.net. Recourse to the mediator can also be made by standard mail (attach your email, phone number, and written complaint) to CM2C 14 rue Saint Jean 75017 Paris.

LEGAL GUARANTEES

Products sold by Lagoped benefit from the legal guarantee of conformity provided for by articles L. 217-4 to L. 217-12 of the Consumer Code and the legal guarantee against hidden defects in the item sold under the conditions provided for in articles 1641 to 1648 and 2232 of the Civil Code, provided that the use thereof has been normal and that the care instructions have been followed by the client.

LEGAL GUARANTEE OF CONFORMITY

In accordance with articles L. 217-1 et seq. of the Consumer Code, Lagoped ensures the guarantee of conformity of the products sold.

When implementing the legal guarantee of conformity, the client:

- benefits from a period of two (2) years from the delivery of the goods to act;

- may choose between repair or replacement of the goods, provided that this choice does not result in a cost that is manifestly disproportionate for Lagoped compared to the other modality, taking into account the value of the goods or the importance of the defect. The client is exempted from providing proof of the existence of the lack of conformity of the Product during the twenty-four (24) months following the delivery of the new product and six (6) months following the delivery of a used product. Beyond this period of six (6) months for used products, the client must provide proof that the goods are not suitable for the use usually expected of a similar good or that they do not present the characteristics defined by mutual agreement between the parties.

This legal guarantee of conformity applies independently of any commercial guarantee that may be granted.

Products sold benefit from legal guarantees provided that the use has been normal and that care instructions have been followed.

This guarantee does not cover damage resulting from misuse of the product or normal wear and tear due to its use. To benefit from the product guarantee, it is imperative to keep the purchase invoice of the product.

For all product returns and after-sales service, the return procedure must be requested by the Client by sending an email to: client@lagoped.com.

GUARANTEE AGAINST HIDDEN DEFECTS

The client may also decide to implement the legal guarantee against hidden defects of the Product sold within the meaning of article 1642 of the Civil Code, arising from a defect in design or manufacture of the product and rendering it unfit for the use for which it was intended, excluding any negligence or fault of the client. The latter may then choose between the cancellation of the sale or a reduction of the sales price in accordance with article 1644 of the Civil Code.

LAGOPED WARRANTY

We guarantee all our items for 5 years within the framework of use consistent with their intended purpose.

The implementation of the warranty means that you do not pay for repair costs, but transport costs are at your expense. We are proud of what we have designed, conceived, and manufactured. This warranty does not cover wear and tear related to non-compliant use of the item. For example: tearing due to a fall, a cut by a sharp object (stick), cutting edge (ski edge), or sharp tool (ice axe). If the defect is not eligible for the warranty claim, we will offer you an economical repair for your damaged item.

To register the warranty, you will need your receipt and you must:
1. Go to the Lagoped webpage.
2. Click on the link "Register my warranty".
3. Fill out the Typeform with the requested information.
4. Now, you have activated your Lagoped warranty.

After verifying that the quality defect can be covered under the Lagoped warranty, we will provide you with the return slip and repair times.

REPAIRS

Lagoped offers to repair damaged items that are not covered under the Warranty. Repair costs and transport costs will be at your expense.

To return an item for repair, you must:
1. Go to the Lagoped webpage
2. Click on the link "request a repair"
3. Fill out the after-sales service form with the requested information.
4. And we will get back to you quickly with the repair procedure.

Important: If the repair is not covered under the warranty, we will offer you an economical repair for your damaged item and provide you with the return slip as well as indicative repair times.

Items to be repaired must be washed before being shipped.

Repair time
Allow 3 weeks from the shipment of the item for repair, but sometimes delays may be longer in case of repair overload. We do our best and thank you for your patience.

PAYMENT

The price is due upon ordering. Payment can be made using the payment methods indicated during the ordering process on the Site. Our providers respect the required security standards. Your payment information is encrypted and will only be transmitted over the internet in a protected form so that no third party can become aware of it during transport on the network.

The buyer's account will only be debited upon shipment of the available products or services and only for the amount of the products or services sent or downloaded. By exception, in the context of a pre-order, the buyer's account will be debited for the total amount of the products before the shipment of the products. To obtain an invoice showing VAT in particular, simply go to your customer account using your login credentials.

DELIVERIES

We strive to process and ship orders within 1 to 2 business days (Monday to Friday, excluding public holidays) once payment is validated. We offer two delivery methods: standard delivery (Colissimo) and express delivery (Chronopost). Deliveries are made to the address indicated in the order form which can only be in the agreed geographical zone.

Upon receipt of the order, the Client will verify the conformity of the products received in execution of their order. Any anomaly concerning the delivery (namely: missing or damaged products, damaged packages) must be notified, within fourteen (14) days following the receipt of the products by email to the following address: client@lagoped.com

Except for the exercise of the legal right of withdrawal or a request based on legal guarantees, any complaint made beyond fourteen (14) days following the receipt of the products will be considered inadmissible and Lagoped cannot be held liable. Lagoped reserves the right to ask the client to return the non-compliant or damaged product.

LIABILITY

In the online sales process, Lagoped is held only by an obligation of means. Its liability cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.

INTELLECTUAL PROPERTY

All elements of the Lagoped site are and remain the intellectual and exclusive property of Lagoped. It is strictly forbidden to reproduce, exploit, redistribute, or use for any title whatsoever, even partially, elements of the site whether they are software, visual, or sound without our prior written agreement.

ARCHIVING – PROOF

Lagoped will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code. Lagoped's computerized registers will be considered by the parties as proof of communications, orders, payments, and transactions occurring between the parties.

DISPUTE RESOLUTION

These general terms and conditions of sale are subject to French law. In the event of a dispute, jurisdiction is assigned to the competent courts according to the applicable rules of procedure.
